1. Application
1.1 These Terms and Conditions shall apply to the provision of Service by Hackney Music School to the Client.
2.The Services
2.1 Hackney Music School is in the business of providing music lessons and hereby agrees to provide those services, as specified herein (“the Services”) in accordance with, and subject to, the Terms of this Agreement.
2.2 With effect from the Commencement Date Hackney Music School shall, in consideration of the Fees being paid in accordance with the Terms of Payment provide the Services to the Client.
2.3 Hackney Music School will use reasonable care and skill to perform the Services.
3.Fees
3.1 The Client agrees to pay the Fees in accordance with the Terms of Payment.
3.2 The terms of payment are set out as follows:
REGULAR LESSONS:
Regular Weekly classes
3.2.1 one lesson on weekly basis which is taught on a one-to-one basis
3.2.2 The Agreement lasts for a period of 12 months and shall continue as long as both The Company and The Customer want it to continue.
3.2.3 In case of extra lessons or if the month has more than 4 weeks the customer will add the price of it/them to his regular fees.
3.2.4 To re-schedule a lesson, a minimum 48 hours notice has to be given. Lessons cancelled in less than 48 hours before the lesson time cannot be re-scheduled. Lessons can only be rescheduled once.
3.2.5 In the event a lesson can’t be rescheduled by either the customer or the school, it will be refunded.
4.Payment
1 Regular weekly classes are subject to subscription. Payment of the applicable fee as per clause 3 above, are taken every 1st of the month. Cancel your recurring payment at any time and membership will end after 30 days.
2 All sums payable by either Party pursuant to the Agreement are exclusive of any value added tax.
5.Missed lessons
5.1 In the event that the Client, due to any circumstance, fails to attend a scheduled lesson, the Client will forfeit the lesson and the full fee of the lesson.
6.Schedule and Calendar
6.1 Lessons do not take place over the following periods: 2 weeks during winter End of Term holidays
7.Termination
7.1 Hackney Music School may terminate the Agreement immediately if:
- The Client is in breach of any of his/her obligations hereunder;
- Hackney Music School has become bankrupt or shall be deemed unable to pay his debts by virtue of Section 123 of the Insolvency Act 1986; any circumstances whatsoever beyond the reasonable control of Hackney Music School (including but not limited to the termination
of the Services through no fault of Hackney Music School) arise that necessitate for whatever reason the termination of the provision of Services.
7.2 In the event of termination under sub-Clause 5.1 Hackney Music School shall retain any sums already paid to him by the Client without prejudice to any other rights Hackney Music School may have whether at law or otherwise.
7.3 The Client may terminate this Agreement by giving 30 days prior written notice, in accordance with clause 4 and 9 below by email.
8.Confidentiality
8.1 The client’s personal details will be kept confidential at all times. Any transaction is encrypted and secured. All information, including your credit card, is transferred only over HTTPS with up to 256-bit encryption. Servers are verified PCI compliant. Additionally, your credit card
information is not stored on our servers
9.Waiver
9.1 No waiver by Hackney Music School of any breach of the Agreement by the Client shall
be considered as a waiver of any subsequent breach of the same or any other
provision. A waiver of any term, provision or condition of the Agreement shall be
effective only if given in writing and signed by the waiving Party and then only in the
instance and for the purpose for which the waiver is given.
9.2 No failure or delay on the part of any Party in exercising any right, power or privilege
under the Agreement shall operate as a waiver of, nor shall any single or partial exercise of any such right, power or privilege preclude, any other or further exercise of any other right, power or privilege.
10.Notices
10.1 All notices under the Agreement shall be given in writing and e-mailed to info@hackneymusicschool.com by the Client, Parent or Guardian.
11.Law and Jurisdiction
11.1 These Terms and the Agreement shall be governed by, and construed in accordance with, the laws of England and Wales.
11.2 Any dispute or claim between the Parties relating to these Terms shall fall within the jurisdiction of the courts of England and Wales.
11.3 By executing this Agreement on /2024, the Parties hereby agree to be bound by, and subject to, the Terms and Conditions and the provisions of this Agreement.
12.Rescheduling Lessons
12.1 Lessons can only be rescheduled once by the client. In the event of accident, emergency or illness the teacher may need to reschedule the lesson at short notice, and will make every effort to contact the student to communicate that the music lesson will need to take place on
another date.
13.Substitute Teachers
13.1 In the event that the teacher is aware in advance that he is unable to teach a lesson, the school will arrange in a substitute teacher to cover the lesson during the regular lesson time slot / date.
14.Non Competition of Deputy Teachers
14.1 Neither Client nor Deputy Teacher shall solicit any business or enter into any commercial relationship with each other in relation to the field of music lessons and the clauses under this Agreement.
15.The Services and Terms of Payment
15.1 Hackney Music School shall provide the service of music lessons in accordance with the Terms and Conditions.
15.2 The Client shall pay the Fees in accordance with the Terms of Payment specified.
